1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and CheckThatJob Pte. Ltd., doing business as RapydRecruiter ("we," "us," or "our"), concerning your access to and use of the RapydRecruiter platform.

By accessing the platform, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you are expressly prohibited from using the platform and must discontinue use immediately.

2. Use of Service

RapydRecruiter is a B2B SaaS platform designed to assist HR teams, TA Directors, and Hiring Managers with candidate screening and pipeline management. You agree to use the service strictly for lawful business purposes and in compliance with all applicable local, national, and international laws, including fair hiring practices.

3. Data and Privacy

Your use of the platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data in accordance with the Singapore Personal Data Protection Act (PDPA) and the General Data Protection Regulation (GDPR). By using the platform, you represent that you have the right and authority to provide us with the candidate data you upload.

4. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE PLATFORM AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE PLATFORM'S CONTENT OR ANALYTICS.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHECKTHATJOB PTE. LTD., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE TWELVE (12) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

6. Governing Law

These Terms shall be governed by and defined following the laws of Singapore. CheckThatJob Pte. Ltd. and yourself irrevocably consent that the courts of Singapore shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
